Terms of Service

Effective August 20, 2026. These terms apply during the Nydus Chat beta and will be updated, with notice, at public launch.

These Terms of Service ("Terms") are an agreement between you and SR2 Labs LLC ("SR2 Labs," "we," "us"), the operator of the Nydus Chat service at app.nydus.chat and the Nydus Chat client applications (together, the "Service"). By creating an account or using the Service, you agree to these Terms.

1. Who may use the Service

You must be at least 13 years old to use the Service. If you are under 18, you must have your parent or guardian's permission. You may not use the Service if we have previously banned your account.

2. Your account

You are responsible for your account and anything that happens through it. Keep your password secure, and tell us promptly at sdhar@protonmail.com if you believe your account has been compromised.

3. Your content

"Your Content" means messages, files, images, and anything else you submit to the Service.

• You own Your Content. These Terms do not transfer ownership of anything you post to us.
• You give us the license needed to run the Service: a non-exclusive, worldwide, royalty-free license to store, transmit, reproduce, and display Your Content solely as needed to operate, back up, and provide the Service to you and the people you share with. This license ends when Your Content is deleted from the Service, except for copies in routine backups, which expire on the schedule described in the Privacy Policy.
• You are responsible for Your Content. You represent that you have the rights to post it and that it does not violate Section 4.

4. Acceptable use

Do not use the Service to:

• break the law, or encourage or help others break the law;
• post content that infringes someone's copyright, trademark, or other rights;
• harass, threaten, or defame others, or share private information about someone without their consent;
• distribute malware or spam, or attempt to access other users' accounts or non-public parts of the Service;
• post sexual content involving minors (reported to NCMEC and law enforcement without exception);
• interfere with the operation of the Service, including probing, scraping at abusive volume, or evading rate limits or bans.

Hubs may set their own additional rules. Hub owners and moderators may remove content and members from their hubs; we may remove content or suspend or terminate accounts that violate these Terms.

5. Copyright complaints (DMCA)

We respond to notices of alleged copyright infringement that comply with 17 U.S.C. § 512. Our designated agent for copyright notices is:

Notices must include the information required by § 512(c)(3). We may forward notices to the affected user, who may submit a counter-notification under § 512(g). Repeat infringers: we terminate, in appropriate circumstances, the accounts of users who are subject to repeated, well-founded infringement notices.

6. Paid features and self-hosting

Parts of the Service may be offered as paid supporter features, processed by our payment provider (Stripe) through our management service; paid-feature terms and pricing are presented at the point of purchase. Self-hosted instances of the Nydus Chat software run under their operator's own terms, not these. The third-party software licenses for this instance are available at /licenses.

7. Beta status

The Service is under active development. Features may change or be removed, and data may occasionally be lost despite our backups. Please report bugs to sdhar@protonmail.com.

8. Termination

You may stop using the Service and delete your account at any time in account settings. We may suspend or terminate accounts that violate these Terms, create risk for us or other users, or as required by law. For non-emergency terminations we will make reasonable efforts to let you review or export Your Content first.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SR2 LABS LLC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF $100 OR THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE.

11. Indemnification

If someone brings a claim against SR2 Labs LLC arising from Your Content or your violation of these Terms, you agree to indemnify us for the resulting losses and reasonable legal fees.

12. Governing law and disputes

These Terms are governed by the laws of the Commonwealth of Virginia, excluding its conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Virginia, and you consent to their jurisdiction.

13. Changes to these Terms

We may update these Terms. For material changes we will give notice in the Service or by email at least 14 days before they take effect; continued use after that is acceptance. The current version is always at /terms.
